Pursuant to Labor Code Section 6401.9, effective July 1, 2024, all employers (other than those specifically exempted) must establish, implement, and maintain an effective Workplace Violence Prevention Plan.
WHO IS EXEMPT?
Subsection (b)(2) lists employers who may be exempt from the statute:
- Employers who are covered by Title 8, CCR Section 3342 (“Violence Prevention in Health Care”);
- Employers who comply with Section 3342 (even if not legally required to comply);
- The California Department of Corrections and Rehabilitation;
- Law enforcement agencies;
- Employees who telework;
- “Places of employment where there are less than 10 employees working at the place at any given time and that are not accessible to the public, if the places are in compliance with Section 3203” (the IIPP regulation).
I DO NOT HAVE A WVPP – IS IT TIME TO PANIC?
There is no reason to panic. During a recent Cal/OSHA Advisory Committee meeting attended by David Donnell, a representative of Cal/OSHA advised of his intention to post a model WVPP program on Cal/OSHA’s website in March of 2024. When that model program is posted, we will send an update with a link to the program.
